On a serious note - from the H&S perspective - a cruise ship like that, full of old people, with furniture flying about is asking for trouble. And lawsuits.

Whilst the ship is built to certain standards, couldn't the result of any damage / injuries caused by heavy seas be classed as an 'act of God'?

Google BRAEMAR, BOUNCING and BISCAY for another perspective of a Biscay storm in January. Our cabin was on Deck 6 and there were times when our  window was totally immersed and consequently sprung a leak (which was later repaired with the aid of silicon sealant!).

The cruise in question was euphemistically titled 'Sun and Suqs'  though it was more like a magical mystery tour coz we never saw the former and had no idea where we were going to end up (should have been Lisbon and Tangier but we ended up in ANTWERP.

You should see whats its like when it really gets rough ,  I've seen splinters from the bridge windows sticking out of a steel bulkhead after a sea ripped off the starboard bridge wing and the bridge was 4" deep in water (It was 6 decks above the water line  [45 feet]) 68,000 ton bulk carrier Called the Oakwood in North Atlantic 1968.

On reflection there's something seriously amiss with this ships internal organisation. I understand very well that people can stagger and fall over, but not furniture, particularly a piano. Every ship I ever sailed in (on) the furniture in the public rooms had "tie downs". Sometimes a chain, sometimes a nicely tasselled bit of braided rope. All fixed in a set location. Generally only used when the ship was expected to bounce around a bit, otherwise everything could be moved around as people wished. To tell the truth, it's quite good fun to be sat on a free moving settee never quite knowing where your'e going to end up! But not as a paying passenger I guess. So in this example the ships organisation must be held at fault. BY.
