Evening All!
I know 2.4GHz radio don't work under water, what modern radios do work? 40Mhz etc? ( For use in USA )

The frequency for land or boats in the USA was 75MHz (or 27MHz) these are less used now as 2.4 GHz is more common but second hand sets should be easily available. This frequency should work with out any problems with submarines.
Note 72 MHz was also used but was only for aircraft and some still use it for this purpose so should not be used in boats. Just like in the UK 40 MHz is for boats or cars and 35 MHz is only for aircraft, some still fly with 35 MHz so it should never be used in boats.
