De Agostini problem

i was recently subscribed to the 'build the yamato' series however in june time i lost my income and had to cancel my subscription.
i wrote to them cancelling my order and no more issues arrived
however today i recived a letter from them saying that i owe £46 and that they would be getting debt collectors on to me for it
i rang them up and was told my two options are to send the issues back ( that i didnt recive )
or pay them the £46 (that i dont have ) before they get the debt collectors on to me...
what do i do ?

Aas Long as you can pove you cancelled the subscription it is really up to them to Prove you have recieved the issues..Which I very much doubt they can do.. was there a cancellation period ?.

As Maddock says Speak to the Citizen's Advice Bureau.

thats the problem. i wrote them a letter...and the issues stopped arriving...so i thought this was done and dusted months ago, im not sure how i can prove i sent them a letter ?

Do you have proof of posting?

Should any debt collector call tell them to get lost and to obtain a court order, then go to court and explain the situation the judge, if it gets that far. Should you loose which I hope you don't, the court will take your circumstances into consideration and may say that you can pay it off at 50p or so a week/month.

Under no circumstances let any debt collector into your home and do not be intimidated by them, they have no powers to enter your property, only a court appointed bailiff armed with a court order can do that, stand your ground, be firm and polite at all times. If they persist report them to trading standards and if necessary, call the police.

Hopefully it won't come to that though.

well after ive phoned them and no more issues arrived, and no more post from them
i get a letter today ( chirstmas eve )
saying that ACT  credit management
have been appointed legal agents of de agostini and they have been instructed by them to collet £51
this is completly out of the blue after i thought that everything had been taken care of ( twice )
now ive no idea what to do...

threaten them with a counter law suit for breach of contract and stress /harrassment caused by their incompetance, between the two of you and that you wish to have the case held in your own local County court small claims division.send it by guarenteed special delivery and a reply needed within 21 days of receipt of your letter

Also tell them that you will be going to the local press, the trading standards and BBC watchdog with copies of your letter.............that should shut them up.....they don't like adverse publicity

Im sorry to read that your being harrased over Christmas. Neils advice is very sound, but if its all to much for you then as suggested please go to the citizens advice beaure. Good luck John.

I would also send a letter to Act them selves as well as the CSA who they show as being accredited to stating harassment etc..

Maybe a simple letter to De Agostini 'accounts payable' dept. stating the facts...

1. Letter sent by post (date) cancelling subscription.
2. Payment 9method) stopped as of ... (date)
3. Last issue received as of... (date & issue no.)
4. "I seem to be being charged for something i have not received, why?"

    Send it recorded delivery.

Add 'Ripoff Britain' TV investigative series, to your list of organisations to be contacted - producers have been recently requesting details of consumer issues to investigate and/or 'name and shame'.
Magazine publishers who con the public into subscribing to their vastly inflated 'model' offers - and, resulting from their administrative incompetance, then threaten legal action at the drop of a hat - are ripe for exposure.

Not Recorded , waste of space send it special delivery costs a bit more but is more guaranteed to get to the correct department than recorded..

I'm having a similar problem with model boats mag cancels my sub about 6 months ago no money has been taken yet they keep sending me the magazine I've written to them explaining this now ther demanding payment for the mags they've sent

CAB will help you resolve this issue. Contact them after the holiday...their experience in these matters is second to none.
