ebay fraud?
« on: March 21, 2014, 12:39:52 pm »

This ebay/UK listing:
http://www.ebay.co.uk/itm/MODEL-RC-BOAT-PLANS-DRAWINGS-YACHTS-TUGS-SPEED-LAUNCHES-TUGS-STEAM-PDF-/171256464619?pt=UK_ToysGames_RadioControlled_JN&hash=item27dfae44eb

...prominently uses my photo of my PT-41 model without permission. I have no idea what's on his DVD, wouldn't be surprised if it's not more borrowed content available for free elsewhere. Original photo at: http://matthewsmodelmarine.wordpress.com/writings/pt-41-building-one-of-the-expendables/

Anyone else recognize their photos, or know who seller "urban_male" is?

Understand your annoyance  but see no  copywrite mention  on your site and    Ebay (apparently ) clears it  with this statement maybe take it up with them good luck

300 plans I would imagine a few Copywrites have been broken.

Send him an invoice for the use of your Pictures

Also have a look at the negative he received and is on his 3rd Id name..

jaymac-
It used to be that one needed to mark their copyrighted material with the word... but current law doesn't require this anymore.

For me, it's not a money issue-- after all, the borrowed material is offered by me for free on my website. It's the lack of credit, and/or the implication that I built my model with HIS plans that annoys me no end!

The GNU license claim is his, not ebay's, and the "no infringement" claim is clearly balderdash.

Been there, seen it, done it, got the tee shirt etc but no satisfactory reply from E-Bay - and certainly no action to remove the offending plans from sale (my drawing of the plans for my design). Don't waste your time like I wasted mine - E-Bay is too big and impersonal and life is too short.

Hi Pat.
As I understood it the photograper owns the copyright to the photographs.
 https://www.copyrightservice.co.uk/protect/p16_photography_copyright

You can can phone e-Bay and indicate that the seller is plagiarizing your work. Also the fact that you have dated feedback on you site about the elco build which originates from sept 2009  urban male on the other hand has only been registered from 08 Dec, 2013 so he deffo has not got a leg to stand on as far as who owns the elco photos. If you sent ebay your site url they could see for themselves that you originated the elco photos the guy is using.
the neg feed back he has received also confirms that  he is a rip off merchant:
CRAP - classic case of copying someone else's disc and not very good at that ! !Buyer: 1***e  ( 56Blue star icon for Feedback score between 50 to 99)  26-Feb-14 15:18

Unfortunately, that's the problem with eBay you need to take people at their word but their are to many con men/ scum on it to make a quick few pounds...
You think you are doing the seller a favour as it can be their giving up due to illness, death of a person or giving up due to time restraints....you buy the items then they reappear some time later same description!!

You buy drawings as it says "built the model want to recoup some of the cost drawings no longer needed" a brand new set of drawings arrive and guess what a few weeks later it's back on...
Hulls for sale, a friend from englandshire bought one never saved that much on RRP it was a copy not a brand hull as advertised not even the same one shown in the pictures and it needed some serious work to fix, he contacted the seller to complain and was offered no replacement but to make him another hull from the selection he was selling he was challenged on this as the reason he was selling was giving up the hobby!! Don't believe he got his money back
Fittings that are clear copies of other peoples, fittings on now that are marked for a model yet it never had anything like them

Look at the crap on eBay just now, hulls and fittings that are really questionable,
I would strongly be very wary of buying from eBay unless you are sure of either who your buying from or can check authenticity of what's being sold

When we buy a crap hull on e---bay we give some money  to a swindler we disadvantage the creator of the hull who made the work

And we have a poop which finally is more expensive that the eccentric.
We buy at the creator's, we pay the price .

If the disparait creator we shall not be responsible

I have to agree with you there Gingyer to a point, Caveat Emptor definitely applies on Ebay... I use Ebay quite a bit and have bought from reputable companies like MMB, Battlecrafts, Nautical Marine Models etc but I have also been stung with con artists selling poor copies as well!!! Feedback is usually a good indicator as to whether a seller is genuine or not, but again buyer beware.....

Paul..

No it is not, that is the kind of bull eBay is pushing to suck in users.
For instance, why can't sellers leave negative feedback about buyers and fleabays comment that they are moving more to a retail result whatever that means.
Don't waste your time, fleabay are only concerned with collecting fees from both sides. End of story.

Without getting into a slanging match, :(( :(( I did give the example that all buyers ratings are incorrect because sellers cannot leave negative feedback, so work it out from there, namely the feedback is usually incorrect  O0 O0 %% %%

But I do agree let the buyer beware and don't believe the fleabay hype, do your own due diligence  :-)) :-))
